The website eshop.gkmobili.gr (hereinafter referred to as "Online Shop") is the online store of the Greek private limited company with the name GK MOBILI IKE and with the distinctive title GK MOBILI, based in Athens, with VAT number 800878576 and G.E.M.I. number 1437727020000, tel. 210-8847439, gkmobili.gr. GK MOBILI IKE complies with all applicable provisions of laws and circulars concerning distance contracts. Visiting and using the Online Store implies automatically the acceptance of these Terms of Use. In case of disagreement with the following terms and conditions, the visitor must not use the Online Store. GM MOBILI IKE reserves the right to unilaterally modify, add, alter or renew the content or services of the Online Store, as well as the Terms of Use, at any time it deems necessary and without prior notice, by simply announcing them through the Online Store.
Products of the Online Store
Furniture and related products (hereinafter "products") are offered for sale through the e-shop.The prices of the e-shop are valid only for orders placed through the e-shop. There may be deviations, for technical reasons, in the photographs of the products presented (e.g. shades). The presentation of products and services for sale on the website has the character of an invitation to users to submit a contract proposal. By placing an order in the Online Shop, GK MOBILI IKE commits itself to the availability and sufficiency of the products in the order and their dispatch within 20 days (except in cases of an unusually large quantity of products in the order or in cases of force majeure). In cases of refusal to receive or inability to deliver the products for reasons beyond its control, GK MOBILI IKE has the right to charge the buyer with the costs of storage and handling of the products in its warehouses. Also, the company reserves the right to cancel the order in case the products remain in its warehouses for more than 40 days and to set off any amount received against the costs incurred in connection with this order.
Limitation of liability of GK MOBILI IKE
GK MOBILI IKE offers for sale the products of the Online Shop in accordance with these terms of use and the applicable legislation. GK MOBILI IKE shall not be liable for any damage or loss that may be caused to customers and/or users of the Online Store, other than the obligation to return, correct or replace products in accordance with the provisions of the sub-pages of this website. GK MOBILI IKE shall not be liable for any form of damage (positive, special or consequential, which, indicatively and not restrictively, disjunctively and/or cumulatively, consists of loss of profits, data, lost profits, monetary compensation, etc.) suffered by the visitor/user of the Online Store or a third party from a cause related to the operation or use of the services, pages, services, services, options and contents of the Website and/or with the inability to provide services and/or information available through the Website and/or with any unauthorized interference by third parties in products and/or services and/or information available through the Website. However, it reserves the reasonable right to interrupt the operation of the Online Shop and/or the individual services for the purpose of carrying out maintenance work on the system without prior notice to the user.
Intellectual and industrial property rights
The content and services of the Online Store, the images, graphics, photographs, any drawings, texts and generally all its files, constitute intellectual property, distinctive features and registered trademarks and/or service marks of GK MOBILI IKE and are protected in accordance with the relevant provisions of the applicable legislation, and are made available to its users strictly for personal (non-commercial or speculative) use. None of them may be partially or totally sold, copied, modified, reproduced, republished or "uploaded", transmitted or distributed in any way without the prior written permission of GK MOBILI IKE. The names, images, logos and distinctive features representing GKMOBILI IKE or third parties and their products or services are the exclusive trademarks of GK MOBILI IKE or third parties, protected by the relevant trademark laws. Their appearance on the Online Shop should not be construed in any way as a transfer or assignment of a license or right to use them.
Responsibility of the visitor / user
The use of the Online Store must be used exclusively for legitimate purposes and in a manner that does not restrict or prevent its use by third parties. The visitor is obliged to use the Online Store in accordance with the law, morality and these terms and conditions, and not to perform any acts or omissions that may cause damage or malfunction to it, affect or endanger the provision of services by GK MOBILI IKE. Submit an order
Orders must be received via the Online Store by filling in and sending the relevant Order Form. During the above procedure the various stages up to the conclusion of the contract are described step by step The prices of the products include VAT. GK MOBILI IKE reserves the right to change prices without notice without affecting the prices of orders already registered.
When submitting the order, the customer is given the opportunity to choose whether the document issued for the order will be a retail receipt or a sales invoice. An invoice is issued to companies and freelancers if they fill in the following details when placing their order: Company name, Tax ID, Tax Office, Headquarters and delivery address and profession. Any changes to the invoicing data can be made until the delivery date is finalised by the dispatch department.
Right to cancel an order and right of withdrawal
Each customer of the Online Store has the right, in accordance with the applicable legislation, to cancel the order within three (3) calendar days from the date of its completion, without any charge, or to withdraw from the sale without justification, within 14 calendar days from the receipt of the products.
Applicable law and other terms
Any provision of the above terms becomes contrary to the law, shall automatically cease to be valid and shall be removed from the present, without in any way affecting the validity of the other terms.
Any waiver, granting of a time limit or non-application of one or more of these Terms by GK MOBILI IKE shall not be construed as a waiver, whether temporary or final, partial or total, of any right or claim arising from them or by law.
This Agreement shall be governed by European and Greek law.
